COVID-19-RELATED REQUIREMENTS AND POLICIES:
Leahi Swim School, Inc. (also known as “Lē‘ahi Swim School” and hereafter, for the purposes of this document, referred to as LSS) has implemented the following measures in response to the ongoing threat of COVID-19.

Covid Illness:
If the student tests positive for Covid with a current PCR Test they will be eligible for a voucher for the missed lesson(s) occurring during the active quarantine period. Other Covid circumstances will be reviewed on a case by case basis at LSS sole discretion.

Face Masks / Face Shields
Face masks and face shields are optional.

Social Distancing
All clients are asked to use their best judgement when sitting on the pool deck.

Release of Client Information
LSS may release client information, including but not limited to, names, phone numbers and addresses, upon request from health authorities or other government entities or upon receipt of a court order or similar legal instrument, and in accordance with any and all applicable regulations or statutes, to support all official efforts to track or contain the spread of COVID-19.

Risk Acceptance
Registering for and attending lessons implies full client acknowledgement and acceptance of the fact that there is no known device, procedure, protocol, guideline, substance, medicine, vaccine or other agent that has been scientifically proven to be completely effective in preventing COVID-19 infection. By electing to attend lessons, clients further acknowledge and accept that COVID-19 exposure or infection are possibilities that LSS has no control over and cannot guarantee against.

TUITION / FEES:
Full payment (tuition plus all applicable fees) is due at the time of registration.

Registration Fee
Fee is applied per student per session / program. If applicable, the registration fee will be automatically added to the tuition at the time of registration. The registration fee is NOT REFUNDABLE in the event of a withdrawal, cancellation or government-mandated closure.

Reservation Fee
A portion of the total tuition paid per student per session / program is NOT REFUNDABLE in the event of a withdrawal, cancellation or government-mandated closure.

Returned Check Fee
A check that has been returned / not honored by the issuing bank will incur a fee.

Transfer Fee
A transfer fee may be assessed for changes to an existing enrollment.

WITHDRAWALS:
Enrollment withdrawals less than one week before the first lesson, or at any point after the session has begun, will not be eligible for any type refund. All withdrawals need to be handled DIRECTLY by LSS.

MISSED / CANCELLED CLASSES:
Classes are held rain or shine. Classes that are missed or cancelled for whatever reason, whether on the part of the student, the parent or guardian, or LSS, including but not limited to illness, scheduling conflicts, emergencies such as fecal accidents or loss of utilities, government-mandated closure, inclement weather or acts of God, will not be rescheduled or refunded.

ILLNESS:
As a courtesy to everyone at the school students who are ill are required to stay home.

HAIR:
Hair that is shoulder-length or longer must be secured into pony or pigtails using a rubber band or hair tie (no metal / plastic pins or clips). Clients are responsible for providing their own rubber bands or hair ties. Students that do not have their hair properly secured will not be allowed to swim.

PROHIBITED ITEMS:
Earrings or body piercings are not allowed in the pool. Additionally, glass items including but not limited to glassware and glass bottles are not allowed on site.

POTTY TRAINING:
Students who have not been potty trained for at least 6 months by the start of the session, or who are potty trained BUT under 3 years of age, are required to wear approved reusable swim diapers. Reusable swim diapers are available for purchase from LSS. Regular diapers and disposable swim diapers are not allowed.

PHOTOS:
Students may be photographed during a session at the discretion of LSS. These photographs may be used in advertising or publicity. Photos taken during an Underwater Photo event are placed online for the convenience of viewing and purchasing. Only LSS clients are permitted to access the online site. Requests to exclude your child’s photos must be submitted to us in writing.

TRANSPORT:
Students attending lessons through a school / daycare partner may NOT be picked up from swimming on a sporadic basis. However, arrangements can be made through LSS for a student to be picked up consistently after each lesson for the entire duration of the program. Students whose rides are not present to pick them up at the end of the lesson will be transported back to school / daycare by LSS regardless of any previously established pick-up arrangements. Parents / guardians that bring their children to lessons are responsible for remaining at the pool during lessons AND for transporting their children back to school / daycare after lessons.

EARNING REFERRAL REWARDS:
For each referral that results in a new enrollment, the referring party becomes eligible to earn referral rewards. The party that is being referred is also eligible to receive referral rewards. “New enrollment” is defined as a referral which results in the enrollment of one or more students by a brand new client. The “re-enrollment” of previously enrolled students, or the enrollment of a “new-to-Leahi” student by a previous client (i.e. a sibling of former LSS student who himself/herself has never attended LSS), will not earn referral rewards. Only the referred party’s FIRST TRANSACTION is eligible for earning rewards. Subsequent transactions will not earn referral rewards. Earned referral rewards are added to the relevant accounts on the first day of lessons for each enrollment that was part of the referred party’s first transaction.

USING REFERRAL REWARDS:
Earned referral rewards can be used in tandem with other account discounts (i.e. Service Member discount). Earned referral rewards do not expire. Earned referral rewards are NON-TRANSFERABLE.

OTHER REFERRAL REWARDS TERMS AND CONDITIONS:
Referral rewards are NOT earned if payment is pending or if the referred party’s first transaction results in a prorated (partial) enrollment. There is no limit to the amount of referral rewards that a customer can earn from referring new clients. LSS, in its sole discretion, reserves the right to void referral rewards. Referral rewards carry no cash value.

This agreement acknowledges parental or guardian consent for all students listed under this account to participate in swimming instruction at LSS. The student(s) has/have had a health examination within the last six (6) months and his/her/their general health permits participation in water activities. I acknowledge that it is my responsibility to determine with a medical doctor if there are any medical conditions that would contraindicate participation in a swimming program and to notify LSS in writing at the time of determination.

In consideration of permitting the listed student(s) to enroll in a swimming program at LSS, which may include transportation services provided by LSS, from this day forward, for all subsequent lessons and activities at LSS or for transportation to or from LSS by LSS or its provider(s), I hereby voluntarily release, discharge, waive and relinquish any and all actions or causes of action for personal injury, property damage or wrongful death occurring as a result of engaging in said programs. I agree to indemnify and hold harmless LSS, their agents and employees against any and all liability for personal injury resulting from participation in the programs. This release shall remain in full force and effect including during enrollment breaks from year to year. All future enrollments via electronic or paperless means shall be deemed a release herein.

I further understand and agree that these lessons and activities do not imply or make any guarantee of water safety for the above named student(s) and that I must therefore supervise or provide supervision for said student(s) at all times when around bodies of water including while on LSS property.

I acknowledge that I am authorized and empowered to sign this agreement, that I have fully read and understand the foregoing paragraphs, that I agree to abide by the terms and policies stated above, that LSS has the right to refuse service to anyone and/or to amend its policies at anytime and without cause, that I have been fully and completely advised of the potential danger incidental to engaging in swimming activities, and that I am fully aware of the legal consequences of signing below.
